In a strongly worded open letter addressed to the Chief Justice of the Supreme Court of Liberia, political and civil rights activist Foday N. Massaquoi has called for the immediate rejection of a recent submission for reargument filed by representatives of the Boakai administration.
Massaquoi, who serves as the National Chairman of the CDC Council of Patriot, praised the Chief Justice for her courage and constitutional loyalty amidst what he described as growing political intimidation. He urged the Supreme Court to stand firm and refuse to entertain any further filings on the legislative crisis until the Executive branch fully complies with the Court’s original ruling.
On April 23, 2025, the Supreme Court ruled that actions taken without a legitimately elected Speaker of the House of Representatives were unconstitutional, effectively nullifying maneuvers led by Representative Richard N. Koon. Massaquoi criticized President Joseph N. Boakai for continuing to recognize Rep. Koon’s bloc, stating that this deliberate disregard for the Supreme Court’s decision undermines the rule of law.
“Until the Executive branch enforces the Court’s decision, it would be inappropriate for the Court to entertain any further submissions on a matter where its initial ruling remains disregarded,” Massaquoi emphasized.
The activist outlined four major arguments for rejecting the reargument:
- Adherence to the Constitution: Massaquoi cited Article 2 of the 1986 Constitution, stressing that the Supreme Court’s decision is binding and must be enforced before any further legal consideration is given.
- Initial Rejection of the Court’s Ruling: He argued that Rep. Koon’s refusal to comply with the Court’s directive disqualifies him and his bloc from seeking any further relief from the Judiciary.
- Threats Against the Chief Justice: Massaquoi expressed grave concern over threats of impeachment made against the Chief Justice by regime-allied lawmakers, calling it a violation of Article 73 of the Constitution, which protects judicial officials from retaliation based on their rulings.
- Political Manipulation: He described the regime’s request for reargument as a strategic attempt to entrap the Chief Justice and create a pretext for political impeachment, thereby weakening the Judiciary’s independence.
Chairman Massaquoi concluded his letter by urging the Chief Justice to “vehemently reject” any submissions from regime representatives until full constitutional compliance is achieved.
“Only when constitutional respect is restored should any such petition be considered,” he wrote.
